1. Agreement to Terms
By accessing or using Figo's services, including our website, mobile application, virtual and physical cards, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms constitute a legally binding agreement between you and Figo Boost, a Delaware corporation doing business as Figo ("Figo," "we," "us," or "our").
2. Eligibility
To use our Services, you must:
- Be at least 18 years old
- Be a resident of a country where Figo operates
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using financial services under applicable laws
- Complete our identity verification process
3. Account Registration
To access certain features of our Services, you must create an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
4. Figo Card Services
4.1 Virtual and Physical Cards
Figo provides virtual and physical prepaid cards that allow you to make purchases at merchants that accept Visa. Cards are issued by our banking partners and are subject to their terms and conditions.
4.2 Funding Your Account
You may fund your Figo account through:
- Bank transfers to your virtual dollar account
- Stablecoin deposits (USDC, USDT, and other supported stablecoins)
Funds must be from legitimate sources. We reserve the right to reject or reverse any funding that we suspect to be fraudulent or in violation of applicable laws.
4.3 Transaction Limits
Your account may be subject to transaction limits, including daily spending limits, withdrawal limits, and funding limits. These limits may vary based on your verification level and account history.
5. Fees
Figo charges fees for certain services. Current fees are disclosed in our Fee Schedule, which is incorporated into these Terms by reference. We reserve the right to change our fees with 30 days' notice.
6. Prohibited Activities
You agree not to use our Services for:
- Any illegal purpose or in violation of any laws
- Money laundering, terrorist financing, or other financial crimes
- Fraud or deceptive practices
- Purchasing illegal goods or services
- Circumventing any limits or restrictions on your account
- Interfering with or disrupting our Services
- Accessing accounts belonging to others without authorization
7. Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by Figo or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
8. Privacy
Your use of our Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES.
11. Indemnification
You agree to indemnify and hold harmless Figo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services or violation of these Terms.
12. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, you remain responsible for any outstanding obligations, and we will return any remaining funds to you minus applicable fees.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
